Domestic workers who are not registered or do not have their rights respected in accordance with the law can sue employers in the Labor Court.

The INSS must be equivalent to 20% of the employee's salary; Of the total, 12% are paid by the employer and the other 8% must be deducted from the employee, directly at the time of payment. The transport voucher is not required if the employee resides at the same address where he works.

The amount of the Income Tax that can be deducted from the employee is equivalent to 12% of the total income paid to the employee throughout the year. This includes salaries, the 13th and paid leave, provided that the maximum allowance does not exceed the amount of R $ 810.60.

Finally, the FGTS is optional. If you wish to give this benefit to your employee, you must open an account at Caixa Econômica Federal exclusively for this purpose. After that, deposit 8% of the salary each month. Employees enrolled in the FGTS - and only these - are entitled to the benefit of unemployment insurance.

Finally, the payment of overtime is not required by law in the case of domestic servants.
